The petition is factually empty, legally pathetic and poorer in logic – Gabby quotes Tsatsu Tsikata

A leading member of the ruling New Patriotic Party (NPP), and a cousin of the President, Gabby Asare Otchere-Darko has restated a famous quote by a leading member of the National Democratic Congress (NDC) Legal Team, Tsatsu Tsikata.

This quote as used by Gabby in the context of 2020 Election Petition, seems to make mockery of the petition filed by the flagbearer of the NDC, John Dramani Mahama, with the Supreme Court in challenge of the 2020 Presidential election.

Gabby Otchere-Darko sought to argue by the statement made by the legal brain during the 2012 election petition which was filed by then candidate Nana Addo Dankwa Akufo-Addo, that the petition filed by John Mahama is “dead on arrival”.

Gabby Otchere-Darko quoted Lawyer Tsatsu Tsikata on his Twitter handle as; “The petition before the Supreme Court is factually empty, legally pathetic, poor in arithmetic, and poorer in logic.”

He draws on this quote to make ‘rubbish’ of the claims raised by the NDC and John Mahama, which they prayed the court directs the Electoral Commission to call for a re-run of the election.

Among several reliefs sought by John Mahama, is the plea to the court that President Nana Addo Dankwa Akufo-Addo should be restrained from holding himself as President-elect for the 2020 election, on grounds that conditions as stipulated in Article 63 of the 1992 Constitution was not met.

The cases as cited by the NDC is that the Electoral Commission commited some serious constitutional breaches in conducting the election and as well in the declaration of the results in “favour of President Akufo-Addo.”
